01Agreement to these terms
These Terms of Use govern the use of Spatial7 EAM, including the Spatial7 website, the Launch Platform, the client portal, the Spatial7 Academy and the Spatial7 EAM mobile applications, provided by Spatial7 Pty Ltd (Spatial7, we, us, our).
By accessing or using the platform you agree to these terms. If you use the platform on behalf of an organisation, you confirm that you are authorised to accept these terms for that organisation, and the words you and your include that organisation.
02Accounts and access
- Accounts are created by invitation or registration and are issued to individuals. Keep your credentials confidential and do not share an account.
- You are responsible for the accuracy of the information entered under your account and for activity carried out through it.
- Platform administrators can grant and change roles. Elevated roles, including administrator access, should be granted only to people who need them.
- Access to records is scoped to the organisation that owns them. Attempting to access another organisation's records is a breach of these terms.
03Licence to use the platform
Subject to these terms and to any subscription agreement with your organisation, we grant you a non-exclusive, non-transferable right to use the platform for your organisation's internal asset management purposes during the term of your access.
You must not copy, modify, resell, sublicense, scrape, reverse engineer or attempt to extract the source code of the platform, except to the extent permitted by law.
04Acceptable use
- Do not use the platform for any unlawful purpose or in breach of any applicable standard, regulation or contract.
- Do not attempt to gain unauthorised access to any account, record, dataset or system, or interfere with the availability or integrity of the platform.
- Do not upload malicious code, or content you do not have the right to provide.
- Do not knowingly record false, misleading or unverified asset, condition, defect, cost or valuation information. Record accuracy is the foundation of every decision the platform supports.
- Follow your organisation's work health and safety procedures when working in the field. The platform is a record-keeping tool; it is not a safety system, and it does not replace site procedures, permits or competent judgement.
05Customer data and ownership
The asset, spatial, operational, project and financial records your organisation enters remain your organisation's data. We process that data to operate the platform and to provide the services your organisation has requested.
Spatial7 owns the platform, its software, its asset taxonomy, its documentation, and any aggregated or de-identified information we derive to improve the platform.
Where your organisation's agreement ends, we will make the organisation's data available for export in accordance with that agreement.
06Spatial data, calculations and advice
Spatial7 stores geometry against the authoritative coordinate reference system configured for the project and transforms it for display. Where source data arrives without a known reference, values are held for review rather than assumed, and affected records are flagged.
Derived values, including asset group, geometry measures, remaining useful life, depreciation, written-down value, risk scores and renewal forecasts, are calculated from the data supplied and the methods configured by your organisation. They are only as reliable as that data and those configurations.
Spatial7 EAM does not provide engineering, legal, accounting or financial advice. Verify derived figures before relying on them for safety decisions, statutory reporting, valuations or financial statements.
07AI-assisted features
AI-assisted outputs are generated suggestions. They may be incomplete, out of date or incorrect, and they must be reviewed and approved by a competent person before being used or relied on.
08Mobile applications and third-party services
The mobile applications are distributed through the Apple App Store and Google Play. Your use of those stores is governed by the stores' own terms, and Apple and Google are not parties to these terms and provide no warranty in relation to the platform.
The platform may link to or interoperate with third-party services. Those services are governed by their own terms, and we are not responsible for them.
09Fees
Access to the platform for client organisations, implementation, data migration, configuration and training may be provided under a separate written agreement or statement of work, which prevails over these terms if there is any inconsistency. App store purchases are handled by the relevant store, and their refund policies apply to those purchases.
10Availability and support
We aim to keep the platform available and to carry out maintenance with reasonable notice, but we do not guarantee uninterrupted or error-free operation. Support is provided through the contact details published on this site.
11Suspension and termination
We may suspend or end access where these terms are breached, where fees are unpaid, where continued access would be unlawful, or where the platform is misused. Where practical we will give notice and an opportunity to remedy, unless the risk to the platform or to other organisations requires immediate action.
12Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
Subject to that, and to the extent permitted by law, we exclude liability for indirect or consequential loss, loss of profit, loss of anticipated savings and loss of data, and our total liability is limited to the fees paid for the twelve months preceding the claim, or to the resupply of the affected service, at our option.
13Privacy
Our handling of personal information is described in the Privacy Policy, which forms part of these terms.
14Governing law
These terms are governed by the laws of Queensland, Australia, and the courts of Queensland have jurisdiction over any dispute arising from them.
